TomTom Trademarks and Guidelines on their Use

TomTom, TomTom’s logo, and further marks of TomTom are registered or unregistered trademarks of TomTom International B.V. and/or affiliated companies (collectively and individually referred to as TomTom) in the European Union and other countries. Subject to exemptions by law or doctrine and agreements and/or an agreement with TomTom, use of TomTom’s trademarks is exclusively reserved to TomTom.

Several jurisdictions recognize restrictions on trademark protection allowing a limited and specific use of trademarks without permission of the copyright holder, such as nominative fair use, e.g. to indicate product compatibility. If you are unsure whether your intended use would fall under such restrictions, please seek legal counsel. In any case, use of TomTom word marks must comply with the following criteria.

The word mark must

• not be abbreviated or varied;

• unless referring to TomTom as a company, not be used as a noun or in a possessive form (e.g. “TomTom’s”) and instead be used as an adjective with a common noun descriptor such as “application”, “software”, etc.;

• be capitalized as in TomTom marketing materials;

• not be shown more prominently than your own tradename or trademark;

• not be used as part of your or a third party product, company, service, trade, domain, social media page, e-commerce channel or app name and must not be registered as such.

Furthermore, the use must

• not be obscene and disparaging, defamatory, or libelous to TomTom, its brand, services, products, and technology or any person or entity;

• subject to an agreement with TomTom, the use must not directly or indirectly state or imply sponsorship, affiliation, or endorsement by TomTom;

• not include any false statement about TomTom; and

• subject to an agreement with TomTom, include the trademark notice “<TRADEMARK(S)> is/are the registered or unregistered trademark(s) of TomTom International B.V. and/or its affiliates in the European Union and other countries.” (where in <TRADEMARK(S)> is to be replaced with a list of the used word marks).
