TomTom Data Act Statement

This Statement explains how TomTom complies with the EU Data Act, and how you can access your data and transfer it to a third party.

1. TomTom products

If you purchase a TomTom Personal Navigation Devices (the “PND”) from third-party retail websites or TomTom.com after 12 September 2025, certain data will be generated through your use (the “Data”).

The Data includes both personal data and non-personal data. Examples include product settings, location history and usage logs.

2. Your data, your right

Your data is protected with strong digital rights management encryption to prevent loss and unauthorized access, ensuring it remains secure and accessible only with your authorization. In addition, some data remains inaccessible due to sensitivity, security, and privacy considerations. For instance, deidentified location data, and derived data (traffic congestion) are out of scope.

The PND generates data continuously in real-time and stores it either on-device or remotely. While data formats vary by type, the Data provided to you is machine-readable.

Accessible data is organized into three categories “personal data”, “product information data”, and “system usage data”, each with its own access method explained below. You can access all your Data free of charge.

3. Transferring your data to others

If you want to give another person (e.g., a repair shop) access to your Data, you may follow the same download steps above and transfer the Data through a secure manner to the third party. Important: You are responsible for ensuring they only process Data you agreed to share. TomTom is not liable for any incidents once data is shared.

3.2 Transfer restrictions
You are not allowed to use the Data to develop a connected product that competes with PND, nor share the Data with a third party with that intent; use such Data to derive insights about the economic situation, assets, and production methods of TomTom; abuse gaps in TomTom's technical infrastructure which is designed to protect the Data; share the Data with a third-party considered as a gatekeeper (e.g., Google, Amazon); or use the Data for any purposes that infringe EU law or applicable national law.

4. Subsequent user and multiple users

Will you sell the products in a secondhand market? Or do multiple people use the device?
