TomTom International B.V., TomTom Global Content B.V., and/or affiliated companies (collectively or individually referred to as “TomTom”) respect the intellectual property rights of others. If you believe that a TomTom website or another service or product provided by TomTom contains illegal content, such as a copyright infringement or other violations of your rights, please notify TomTom as outlined below.
TomTom will investigate your claim and take corresponding action, e.g. by removing infringing content.
Please send a sufficiently substantiated notification using the form below. This form is intended solely for submitting notices concerning alleged illegal content, including intellectual property rights infringements. Submissions that are unrelated to such matters may be disregarded and may not be processed.
For an effective notice under the EU Digital Services Act (Regulation (EU) 2022/2065), your notification should include:
(a) a sufficiently substantiated explanation of the reasons why the individual or entity alleges the information in question to be illegal content;
(b) a clear indication of the exact electronic location of that information, such as the exact URL or URLs, and, where necessary, additional information enabling the identification of the illegal content adapted to the type of content and to the specific type of hosting service;
(c) the name and email address of the individual or entity submitting the notice, except in the case of information considered to involve one of the offences referred to in Articles 3 to 7 of Directive 2011/93/EU;
(d) a statement confirming the bona fide belief of the individual or entity submitting the notice that the information and allegations contained therein are accurate and complete.
For an effective notice of a copyright infringement under the United States Digital Millennium Copyright Act, the following information is required:
(i) a physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest;
(ii) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered
by a single notification, a representative list of such works at that site;
(iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit TomTom to locate the material;
(iv) information reasonably sufficient to permit TomTom to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
(v) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
(vi) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Claimants who make misrepresentations concerning copyright infringement may be liable for damages incurred as a result of the removal or blocking of that material, court costs, and legal fees. TomTom collects the provided information, including name and contact information, to process the claim. TomTom may share your information where necessary to process and investigate your notification, including where required by law or where necessary to notify an affected user.
